The Builder reserves the right, at its sole discretion, to take any of the following actions without prior notice when deemed necessary to maintain construction quality, design integrity, scheduling requirements, or overall project budget.

1. Selection of Alternatives

The Builder may select from any alternatives identified within the approved plans, drawings, or specifications, including but not limited to layouts, products, fixtures, components, and construction methods, provided such alternatives remain consistent with the intended design and functional objectives of the project.

2. Substitutions and Value Engineering

The Builder may substitute materials, equipment, or finishes with items of equal or greater quality, durability, or performance. This includes the use of value-engineered solutions necessary to maintain the project budget, address supply or manufacturing constraints, or improve construction efficiency, provided such substitutions do not materially alter the intended aesthetic or performance standards.

3. Architectural Control

The Builder retains full architectural control over all exterior elements of the home or development. This includes, without limitation, the selection and final approval of exterior colours, materials, finishes, architectural details, and design options to ensure consistency with community standards and overall project vision. All such decisions by the Builder shall be final and binding.

4. Limits of Liability

To the fullest extent permitted by law, the Builder shall not be liable for any indirect, incidental, special, or consequential damages arising from design modifications, material substitutions, construction methods, or value-engineering decisions undertaken in accordance with these terms. The Builder’s liability, if any, shall be strictly limited to the warranties expressly provided under the purchase agreement or applicable legislation.

5. Changes to Plans, Elevations, and Specifications

The Builder reserves the right to modify, revise, or amend floor plans, elevations, site plans, specifications, and construction details as necessary to comply with building codes, supply availability, engineering requirements, or other conditions beyond the Builder’s control. Such changes may include, without limitation, adjustments to room dimensions, window placements, mechanical layouts, or exterior treatments. All dimensions and illustrations are approximate and subject to change without notice.

6. Municipal, Code, and Regulatory Compliance

All construction is subject to municipal regulations, building code requirements, zoning bylaws, and utility or servicing constraints. Where required for compliance with applicable laws or regulatory authorities, the Builder may make changes to grading, elevations, construction methods, material selections, structural components, or exterior appearances. Any such changes shall be considered permissible and shall not constitute a breach of contract or specification.

7. Options & Add-Ons

Any optional upgrades, customizations, or add-on features requested by the Purchaser and not included in the agreed-upon sale price shall be priced separately. All associated costs shall be calculated and invoiced by Wilson Developments and must be paid by the Purchaser prior to closing. The Purchaser acknowledges and agrees that such charges will be billed directly to them and must be settled in accordance with the payment terms provided.

The home is enrolled in the Tarion New Home Warranty Program, and the Purchaser shall receive coverage in accordance with the statutory protections provided under Ontario’s Tarion Warranty Corporation. Warranty coverage includes, but is not limited to, the one-year, two-year, and seven-year major structural warranty protections as prescribed by applicable legislation. All claims, procedures, and warranty service requirements shall follow Tarion’s rules, guidelines, and timelines.
